பாலியல் குற்றங்களிலிருந்து குழந்தைகளைப் பாதுகாக்கும் சட்டம் 2012 என்பது , இந்தியாவில் பாலியல் குற்றங்களிலிருந்து குழந்தைகளைப் பாதுகாக்க உருவாக்கப்பட்ட சட்டமாகும்.
இச்சட்டம் , மாநிலங்களவையில் 2012 ஆம் ஆண்டு மே மாதம் 10ம்தேதியும், மக்களவையில் மே மாதம் 22ம் தேதியும் நிறைவேற்றப்பட்ட சட்டமாகும்.
சட்டத்தின் பொதுவான அம்சங்கள்
  1. 18 வயதுக்குக் குறைவான அனைத்துக் குழந்தைகளும் பாலின வித்தியாசமின்றி, இச் சட்டத்தின் வரையறைக்குள் வருவர்.
  2. அதாவது ஆண் குழந்தைகள், சிறுவர்களும் பாதிக்கப்பட்டாலும், இச்சட்டம் தலையீடு செய்யும்.
  3. பாலியல் தாக்குதல்/வன்முறை, பாலியல் துன் புறுத்தல்/சீண்டல், ஆபாசப் படமெடுக்கக் குழந்தைகளைப் பயன்படுத்துதல் போன்றவற்றைக் குற்றங்களாக இச்சட்டம் முன்வைக்கிறது.
  4. 30 நாட்களுக்குள் குழந்தையின் சாட்சியம் பதிவு செய்யப்பட வேண்டும். ஒரு வருடத்துக்குள் வழக்கு முடிய வேண்டும்.இது மிகத் தேவையானது.
  5. சாதாரண சிறை தண்டனையிலிருந்து, கடுங்காவல், ஆயுள் தண்டனை வரை கொடுக்க லாம் என சட்டம் குறிப்பிடுகிறது.
  6. சில வகை பாலியல் வன்முறைக்குக் கூடுதல் தண்டனை உண்டு. உதாரணமாக, காவல் துறையினர், பாதுகாப்புப் படையினர், ராணுவம், அரசு அதிகாரிகள் போன்றவர்கள் பாதுகாவலர்கள் அல்லது நம்பிக்கைக் குரியவர்கள்.அவர்களே குற்றம் இழைக்கும் போது, அதிக தண்டனை உண்டு என இச்சட்டம் தெளிவுபடுத்துகிறது.
  7. மாவட்ட அளவில் குழந்தை பாதுகாப்புப் பிரிவு அமைக்கப்பட வேண்டும். தனி காவல் துறை பிரிவும் ஏற்படுத்தப் பட வேண்டும்.
  8. பாதிக்கப்பட்ட குழந்தை எங்கு இருந்தால், அக்குழந்தையின் நலனுக்கு உகந்தது என்று பார்க்க வேண்டும்.
  9. சில சமயம், குடும்ப உறுப்பினர்களே குற்றம் செய்பவராக இருந்தால், அங்கிருந்து குழந்தையை வேறு இடத்துக்கு மாற்ற வேண்டும்.

 

The Protection of Children from Sexual Offences (POCSO) Act, 2012
  1. The Protection of Children from Sexual Offences (POCSO) Act, 2012 was enacted to provide a robust legal framework for the protection of children from offences of sexual assault, sexual harassment and pornography, while safeguarding the interest of the child at every stage of the judicial process.
  2. The framing of the Act seeks to put children first by making it easy to use by including mechanisms for child-friendly reporting, recording of evidence, investigation and speedy trial of offences through designated Special Courts.
  3. The new Act provides for a variety of offences under which an accused can be punished.
  4. It recognises forms of penetration other than penile-vaginal penetration and criminalises acts of immodesty against children too.
  5. The act is gender-neutral. With respect to pornography, the Act criminalises even watching or collecting pornographic content involving children.
  6. The Act makes abetment of child sexual abuse an offence.
  7. It also provides for various procedural reforms, making the tiring process of trial in India considerably easier for children.
  8. The Act has been criticised as its provisions seem to criminalise consensual sexual intercourse between two people below the age of 18.
  9. The 2001 version of the Bill did not punish consensual sexual activity if one or both partners were above 16 years
