இந்திய அரசமைப்பின் சிறப்பியல்புகள்
நீளமான எழுதப்பட்ட அரசமைப்பு
  • இந்திய அரசமைப்பு தான் உலகிலேயே நீளமான எழுதப்பட்ட அரசு அமைப்பாக கருதப்படுகிறது. மாநிலங்கள் மத்திய அரசு மற்றும் அவற்றுக்கு இடையிலான உறவுகள் குறித்த பல்வேறு விதிகளை கொண்டுள்ளது. 
  • நமது அரசு அமைப்பை உருவாக்கிய மேதைகள் உலகின் பல அரசமைப்பு மற்றும் பல்வேறு அரசமைப்பின் மூலங்களிலிருந்து நம் அரசமப்பை உருவாக்கியுள்ளனர். 
  • தனிநபர் உரிமைகளை அடிப்படை உரிமைகளாகும் அரசு கொள்கையின்  வழிகாட்டு நெறிமுறைகளாகவும் செயல்முறை விவரங்கள் என பிரிவாகவும் பட்டியலிடப்பட்டுள்ளன.
இறையாண்மை ,சமதர்மம், மதச்சார்பின்மை, மக்களாட்சி, குடியரசு 
  • வயது வந்த அனைவருக்கும் வாக்குரிமை வழங்கப்பட்ட தேர்ந்தெடுக்கப்படும் மக்கள் பிரதிநிதிகள் மூலம் மக்களே இந்தியாவை ஆள்கிறார்கள். 
  • இந்தியா ஒரு இறையாண்மை கொண்ட அரசை என்றால் தனது உள்நாட்டு வெளிநாட்டு விவகாரங்களை எவ்விதமான வெளிநாட்டு தலையீடு இன்றி நிர்வகிப்பது ஆகும். 
  • இந்திய அரசமைப்பில் சமதர்மம் என்ற சொல் 42வது திருத்த சட்டம் மூலம் இணைக்கப்பட்டுள்ளது. 
  • இந்தியாவில் பொதுத்துறை, முதலாளித்துவம் ஆகிய பொருளாதாரங்கள் இணைந்த கலப்பு பொருளாதார முறை கடைபிடிக்கப்படுகிறது. 
  • மதச்சார்பின்மை என்பது இந்தியாவில் அரசு மதம் என ஒன்று இல்லை. அனைத்து மதங்களும் சமமாக அங்கீகரிக்கப்பட்டுள்ளன என்பதாகும். 
  • இந்திய குடியரசு என்பது இந்தியாவில் முடியரசு மூலமாக அல்லாமல் தேர்தல் மூலமாக அரசின் தலைவர் தேர்ந்தெடுக்கப்படுகிறார் என்பதாகும்.
 நாடாளுமன்ற ஆட்சி முறை
  • அமைச்சரவைக் குழு செயல்பாடுகளை நாடாளுமன்றம் கட்டுப்படுத்துவதால் நாடாளுமன்ற ஆட்சி முறை என அழைக்கப்படுகிறது. 
  • நாடாளுமன்ற முறை அரசியல் நிர்வாகம் நாடாளுமன்றத்துக்கு கட்டுப்பட்டது. 
  • நாடாளுமன்றத்தில் பெரும்பான்மை உறுப்பினர்கள் ஆதரவு இருக்கும் வரை அந்த அரசு நீடிக்கும்.
 ஒற்றைக் குடியுரிமை
  • இந்திய அரசமைப்பு ஒற்றை குடியுரிமை வழங்குகிறது. 
  • ஒன்றிய அரசு வழங்கும் குடி உரிமையை அனைத்து மாநிலங்களுக்கும் ஆனது.
  • 2015 பிப்ரவரி 27 அன்று மக்களவையில் குடியுரிமை சட்டம் 1955 திருத்தங்கள் கொண்டுவந்துள்ளது.
  • பதிவு அல்லது இயல்பு உரிமை முறையில் இந்திய குடியுரிமை கோரி விண்ணப்பிக்கும் நபர் குறிப்பிட்ட தகுதிகளை நிறைவு செய்வதால் அவருக்கு குடியுரிமை வழங்கப்படும். 
  • இந்தியாவில் தொடர்ந்து கூடி இருந்தாலோ அல்லது அரசுப் பணியில் 12 மாதங்கள் இருந்தாலோ ஒரு நபர் இந்திய குடியுரிமை கோரி விண்ணப்பிக்க முடியும். 
வயதுவந்தோர் வாக்குரிமை
  • ஒரு நபர் ஒரு வாக்குரிமைஎன்ற கோட்பாட்டின் அடிப்படையில் 18 வயது நிறைவடைந்து தேர்தலில் வாக்களிக்கும் தகுதி பெறுகிறார்கள். 
  • தேர்தலில் வாக்களிப்பதில் இந்திய குடி மக்களிடையே சாதி, மதம்,பாலினம் அல்லது தகுதி அடிப்படையில் எவ்விதமான பாகுபாடும் கடைபிடிக்கப்படுவதில்லை.
 சுதந்திரமான ஒருங்கிணைந்த நீதி அமைப்பு
  • இந்தியாவில் நீதித்துறையின் செயல்பாடுகளில் நிர்வாக தலையீடோ நாடாளுமன்ற, சட்டமன்றங்களில் தலையீடோ இல்லாமல் இயங்கும் ஒரு தன்னாட்சி அமைப்பு ஆகும். 
  • ஒருங்கிணைந்த இந்திய நீதி அமைப்பில் உச்சநீதிமன்றத்தின் கீழ் உயர்  நீதிமன்றங்கள், கீழமை நீதிமன்றங்கள்,துணை நீதி மன்றங்கள் இயங்குகின்றன.
 
அடிப்படை உரிமைகள்
  • ஒவ்வொரு தனிநபரும் குறிப்பிட்ட அடிப்படை உரிமைகளை அனுபவிப்பதை அடிப்படை கொள்கையாக அரசமைப்பு உறுதிப்படுத்தியுள்ளது. 
  • இந்திய அரசமைப்பு பகுதி III இல்அடிப்படை உரிமைகளுக்கான பிரிவுகள் குறிப்பிடப்பட்டுள்ளன. 
  • அடிப்படை உரிமைகள் 6 தலைப்புகளில் வகைப்படுத்தப்பட்டுள்ளன அவையாவன: 
  • சமத்துவத்துக்கான உரிமை
  • சுதந்திரத்திற்கான உரிமை
  • சுரண்டப்படுவதற்கு எதிரான உரிமை
  • மத வழிபாட்டுக்கான உரிமை, மற்றும் கல்வி பண்பாட்டு உரிமை
  • அரசமைப்பு படி நிவாரணம் கோரும் உரிமை
கல்வியுரிமை
  • இந்திய அரசமைப்பின் (82-வது திருத்தம் 2002 ) இந்திய அரசமைப்பு உறுப்பு 21 (A) வில் 6 முதல் 14 வயது வரையிலான அனைத்து சிறார்களுக்கும் இலவச, கட்டாய கல்வி வழங்குவதை அடிப்படை உரிமையாக இணைத்துள்ளது. 
  • இதை அமுலாகும் வகையில் மாநிலங்கள் விதிகளை வகுத்துக் கொள்ளலாம் என்று இலவச கட்டாய கல்வி சட்டம்,2009 அரசமைப்பு உறுப்பு 21 -(A) கீழ் வழங்கப்படும் அடிப்படை உரிமைகளை நிறைவேற்றும் வண்ணம் இயற்றப்பட்டது.
 
அரசின் வழிகாட்டு நெறிகள்
  • அரசாட்சி தொடர்பாக அரசு கடைபிடிக்க வேண்டிய வழிகாட்டு நெறிகள் இந்திய அரசமைப்பின் நான்காவது பகுதியில் இடம்பெற்றுள்ளன.
  • இந்திய அரசமைப்பின் தனித்தன்மை வாய்ந்த கூறுகளில் ஒன்று அரசு கொள்கை வழிகாட்டு நெறிகள் என்ற பகுதி ஆகும்.
  • இதனை இந்தியாவில் சமூக, பொருளாதார நீதி நிலைநாட்டும் வண்ணம் அரசு அவற்றை அமுலாக்கம் செய்வதற்கான வழிகாட்டு நெறிகள் எனலாம்.
  • ஆணுக்கும் பெண்ணுக்கும் சம ஊதியம், இலவச கட்டாய அடிப்படைக் கல்வி,வேலை பார்க்கும் உரிமை ஆகியவற்றுக்கான குறிப்பிடத்தக்க விதிகளை அது கொண்டுள்ளது. 
  • இந்திய அரசமைப்பின் பாகம் –IV-ன் கீழ் முதுமை, வேலையின்மை, நோய்வாய்ப்படுதல்,வாழ்வதற்கு தேவையான திட்டங்கள், பொருளாதார ரீதியாக பிற்படுத்தப்பட்ட பிரிவு மக்களுக்கு சிறப்பு முன்னுரிமை, வழங்கல் பகிர்வில் உள்ள பாகுபாடுகள் போன்றவற்றிற்கு அரசு உதவிகள் வழங்குவதற்காக பிரிவுகள் கூறப்பட்டுள்ளன. 
  • அரசு கொள்கை வழிகாட்டு நெறிகளில் வழங்கப்பட்டுள்ள விதிகள் நீதி மன்றங்கள் மூலமாக நிலைநாட்டப்பட முடியாது என்றாலும் நாட்டின் அரசாட்சிக்கு மிக முக்கியத்துவம் வாய்ந்ததாக கருதப்படுகின்றன.
 அடிப்படை கடமைகள்
  • 42 –ஆவது திருத்தத்தின் வாயிலாக அடிப்படை கடமைகள் சேர்க்கப்பட்டுள்ளன.
  • அரசமைப்பு பகுதி 51 A வில் வழங்கப்பட்டுள்ள அடிப்படை கடமைகள் ஒவ்வொரு இந்தியனும் பின்பற்ற வேண்டிய கடமைகள்  ஆகும்.
கூட்டாட்சி அல்லது ஒற்றையாட்சி
  • இந்தியா சிதைக்க முடியாத ஒன்றியமும் (மத்திய அரசும்) சிதைக்க தக்க மாநிலங்களும் கொண்ட ஆட்சி முறை ஆகும். 
  • அதாவது நெருக்கடி நிலை காலத்தில் ஒற்றையாட்சி குணாம்சம் கொண்டது என்பது இதன் பொருளாகும். 
  • ஒன்றியம் முழுமையான கூட்டாட்சி என்று கூற முடியாது. 
  • ஆனால் கிட்டத்தட்ட கூட்டாட்சி முறை என்று கூறலாம். 
  • வடிவத்தில் கூட்டாட்சி அமைப்பில் கொண்டிருந்தாலும் இந்திய அரசமைப்பு ஒற்றையாட்சி முறை கூட்டாட்சி முறை இரண்டையும், நேரம், சூழல்களின் தேவைக்கு ஏற்ப பயன்படுத்திக் கொள்ளத்தக்க ஆட்சி முறையைக் கொண்டுள்ளது.
 நீதி சீராய்வு சமநிலை நாடாளுமன்ற மேலாதிக்கம்
  • இந்திய அரசமைப்பு வழங்கியுள்ள அடிப்படை உரிமைகள் மீறப்பட்டால் கண்காணிப்பதும் நாடாளுமன்ற நிர்வாக செயல்பாடுகளில் தேவைப்பட்டால் தலையிடுவதும் நீதித்துறை சுதந்திரம் வழங்கப்பட்டுள்ளது. 
  • இது இந்திய அரசமைப்பின் சிறப்பு கூறுகளில் நீதி அமைப்பும் நாடாளுமன்றமும் ஒன்றுக்கொன்று சமமான மேலாதிக்க தன்மை கொண்டவை. 
  • நாடாளுமன்றத்தில் இயற்றப்பட்ட சட்டம் அரசமைப்பின் அடிப்படைத் தத்துவத்திற்கு முரணாக இருந்தால், அது  செல்லாததாக்கும் அதிகாரம் நீதி சீராய்வு எனப்படும்.

 

Salient Features of Indian Constitution 
Longest Written Constitution: 
  • The Indian Constitution is considered to be the longest written constitution in the world. It contains different provisions for states and centre and their inter-relationship. 
  • The framers of the Constitution have borrowed provisions from several sources and several other Constitutions of the world. 
  • The Indian Constitution contains a detailed list of individual rights as fundamental rights, directive principles of state policy and details of administrative procedures. 
A unique blend of rigidity and flexibility: 
  • Indian Constitution may be called rigid as well as flexible based on its amending procedure. 
Sovereign, Socialist, Secular, Democratic and Republic: 
  • Democracy in India means its people govern India through their representatives elected by the universal adult franchise.
  • India as a sovereign country means it manages its internal and external affairs freely without the interference of any external factors. 
  • The term socialist was added to the Indian Constitution through the 42nd Amendment in 1976. 
  • In India, we follow the mixed model of the socialist and capitalist economy. 
  • Secularism in the Indian context means that it recognizes all religions equally without having any state religion. 
  • Republic in the Indian context means the head of the state in India is elected and not the monarch. 
Parliamentary System of Government: 
  • Parliament controls the functioning of the Council of Ministers, and hence it is called the Parliamentary system. 
  • In a parliamentary system of government, (i.e.) the executive is responsible to the legislature and remains in power only when it enjoys the confidence of the majority legislators. 
Single Citizenship: 
  • Indian Constitution has the provision for single citizenship provided by the union and recognized by all the states across India. Citizenship identifies those who are lawful members of a country. 
  • The Citizenship Act, 1955 regulates the determination and acquisition of citizenship after the adoption of the Indian Constitution. 
  • The Indian Constitution provides for citizenship by birth, descent, registration, naturalization and incorporation of territory. 
  • The Constitution also provides for renunciation and termination of citizenship under certain circumstances. 
  • The Constitution contains provisions regarding the registration of Overseas Citizens of India and their rights. 
  • The Citizenship (Amendment) Bill, 2015 was introduced in Lok Sabha on 27th February 2015 that amends the Citizenship Act, 1955.
Universal Adult Franchise: 
  • The universal adult franchise, which operates with the principle of ‘one person one vote.’ All Indians who are eighteen years of age or above is entitled to vote in the elections. 
  • There is no discrimination in voting rights for the citizens of India based on caste, religion, gender, race or status. 
Independent and Integrated Judicial System: 
  • In India, the judicial system is an autonomous organ kept free from the influence and intervention of the executive and the legislature in exercising its functions. 
  • The integrated Indian judicial system has the Supreme Court at the apex, the high courts and lower courts are subordinate to it.
Fundamental Rights: 
  • The Constitution of India asserts the basic principle that every individual is entitled to enjoy certain essential rights. 
  • The provisions for Fundamental Rights are mentioned in Part III of the Indian Constitution.
  • Fundamental Rights are categorized into six heads; Firstly, Right to Equality, Secondly Right to Freedom, Thirdly Right against Exploitation, Fourthly Right to Freedom of Religion, Fifthly Cultural and Educational Rights and lastly Right to Constitutional Remedies. 
“Right to Education”
  • The Indian Constitution (Eighty-Sixth Amendment) Act, 2002 inserted Article 21-A in the Constitution of India to provide free and compulsory education to all children in the age group of six to fourteen years as a Fundamental Right in such a manner as the State may, by law, determine. 
  • The Right of Children to Free and Compulsory Education (RTE) Act, 2009, which represents the consequential legislation envisaged under Article 21-A, means that every child has a right to full-time elementary education of satisfactory and equitable quality in a formal school which satisfies certain essential norms and standards.”
Fundamental Duties: 
  • The Fundamental Duties were added to the Indian Constitution through the 42nd Amendment. 
  • Part IVA of the Indian Constitution defines the Fundamental duties in Article 51A
Federal or Unitary: 
  • India is an indestructible Union with destructible states which means it acquires a unitary character during the time of emergency. 
  • The Union is not strictly a federal polity but a quasi-federal polity with some vital elements of unitarizes. 
  • Though federal in form, the Indian Constitution, unlike other federal Constitutions, is both unitary as well as federal according to the requirements of the times and the circumstances. 
Balancing Parliamentary Supremacy with Judicial Review: 
  • Subject to the provisions of any law made by Parliament or any rules made by the Supreme Court under Article 145, the Supreme Court has the power to review any judgment pronounced or made by it. 
  • The independent judiciary in India with the power of judicial review is a prominent feature of our constitution. 
  • The harmonization which our Constitution has affected between Parliamentary Sovereignty and a written Constitution with a provision for Judicial Review is a remarkable achievement of the framers of our Constitution.
Directive Principles of State Policy: 
  • One of the unique provisions of the Indian Constitution is the Directive Principles of State Policy. 
  • These principles are like directives to the government to implement them for establishing social and economic justice in India. 
  • It comprises significant provisions for equal pay for both men and women, free and compulsory primary education, and the right to work. 
  • Part IV of the Indian Constitution also has provision for public assistance in case of old age, unemployment, sickness and disablement, the organisation of village Panchayats, adequate means to livelihood, a special privilege to the economically backward sections of the people and distribution of wealth. 
  • Most of these principles could help in making India a welfare state. 
  • Though the provisions given in the Directive Principles of State Policy is not justifiable, these principles are considered very significant in the governance of the country.
